song rights question

I think I know the answer to this but need confirmation....

Our band made 2 albums but only the first was released.
We are no longer signed to the record company.
We were signed to a different publishing company and are still members of PRS.

Q: If we wanted to re-record any of the songs from those albums
we would be free to do this as the record company only owns the recordings
They do not own the songs so we would be free to re-record and release any of them again.

Obviously the record company spent money promoting us but they would not have the power to recoup any of that money via the sales of our re-recorded songs.

Is that correct?

You would obviously need specialist advice on this one

The cheapest way would be to join the Guild Of International Songwriters & Composers (GISC) for a very reasonable annual subscription (less than £100)

They will then give you specialist advice depending on your exact circumstances

I think this would be considerably cheaper than talking to a solicitor and you also get all of the other benefits of GISC

However, I believe you are right in what you are saying

You (and or the publisher) own the rights to the songs themselves and the record company gets paid for when the recordings are played

lol - I was thinking the same thing when this post came up again - as well as other recent posts about collaboration splits, royalties, copyright etc.!

No, I am not affiliated to GISC in any way and I have even let my membership lapse at the moment

The only reason I keep mentioning them is that people are asking some potentially serious questions and raising legal issues - and it could be very dangerous to accept wisdom from strangers on t'internet on forums such as these

The reason I mention GISC is that as a member you get legal support where you can ask music industry experts for advice, a free song assessment service by a label & publisher working in the industry, a quarterly newsletter, unlimited copyright protection for songs for £58 per year

For me the support and backup of GISC for £58 is a no brainer for someone asking these types of questions

The only problem I have with GISC is that they appear very "old fashioned" and dated and the website is awful

Anyone just "browsing" would probably pass them by in the click of a mouse (I know I did many times!) but then someone who was a member recommended them to me so I took a chance and the information really is top notch - it is just a shame their marketing and "shop front" is not up to much

That is exactly what I mean - and I recall mentioning this when I first recommended them to you in another thread

I did contact them directly to tell them that their "shop front" is awful and a few hundred quid re-designing the website would be money well spent!!!!
