Would it be copyright infr to write a so with a similar name to an existing one?

Inrf = Infringement, sorry. I wrote a song called Dublin Skies a few months ago, and while its content is original, some further research revealed two songs with similar names - Dublin Sky and Neath the Dublin Skies. Would my piece of work be considered infringement due to its name, or is it hard to copyright a title like that, only the content?

Hi,

As far as I know, you can't copy-write a title so you would be fine with your song.

A title can't be copyrighted

Only lyrics and melody are protected by copyright

I am not sure how much of a lyric you can use (ie probably not big chunks but the odd line will be fine) but you are definitely ok using a title

The question is though, would you want to?

Do you want people making the same comment about your song forever more - "did you know there is already a song called..."

I think it depends on how well known/iconic the original is

its actually pretty common..
for example :
power of love / frankie goes to hollywood nov 1984
power of love / jennifer rush 1984
power of love / huey lewis  1985
all different songs and all massive hits..

important thing is the idea, if you get a sniff of a song grab it whatever its called..
i may not believe this tomorrow...

 i wrote a lyric called  KENTUCKY RAIN  about a gambling man

 posted it on another site and right off a couple of guys came in
 and told me the king beat you to it try something else

 they even said that they could hear the Elvis song as they read the lyric
 caused an argument because they wouldn't listen when i said it's nothing like it
 
 later seriousfun Allan put the lyric to music
 but i didn't bother going back to prove it to them
 they would prob find something else ( some people eh )

 my point is take no notice the title can not be copyrighted
 if it could eventually we'd run out of titles

    sorry to go on rant over
